Terms of Service

These Terms govern your use of DayOne (the "Service"), operated by Net Gain Realty LLC ("DayOne," "we," "us"). By creating an account you agree to these Terms and our Privacy Policy.
1. The Service
DayOne lets a real estate professional ("you") generate a market report from data you upload, share it as a live link, and see engagement on that link.
2. Your data, and how we use it
We organize data into three categories.
Customer Data
"Customer Data" is the data you submit to or generate in the Service, including the MLS export files you upload and the reports produced for your clients. You own your Customer Data. We use it only to provide the Service to you (to generate, host, and deliver your reports), as your service provider. We do not sell your Customer Data, and we do not redistribute, resell, or commercialize the underlying MLS listing or comparable-sale records.
MLS source data (important)
The comparable-sale and listing records you upload are licensed to you by your MLS for your own permitted use. When you upload them, we act as your processor to produce your report. We claim no right to reproduce, redistribute, resell, sublicense, or build a commercial data product from those MLS records, and we will not use them to reconstruct or substitute an MLS data feed. Those records remain governed by your own MLS agreement.
Engagement Data and Aggregated Data
"Engagement Data" is the data we observe by operating the Service: how report links are accessed and engaged with (views, return visits, multiple-viewer events, and similar signals we generate). "Aggregated Data" is statistical, group-level information we derive from Engagement Data in de-identified form. Engagement Data and Aggregated Data are not Customer Data and are not your Confidential Information. You grant us a perpetual, irrevocable, worldwide, royalty-free, sublicensable, and transferable right to collect, analyze, and, during and after your subscription, use and commercialize Aggregated Data for any lawful purpose, including improving the Service, training models, producing benchmarks and market-intelligence reports, and licensing de-identified, aggregated insights to third parties.
3. De-identification commitment
We maintain and use Aggregated Data only in de-identified, aggregate form. We take reasonable technical and process measures so it cannot reasonably be associated with, or used to infer information about, any individual, household, property, or device, including aggregation to a minimum group size and suppression of small groups. We do not attempt to re-identify it, and we contractually require any recipient of it to do the same.
4. Business transfers
If we are involved in a merger, acquisition, financing, or sale of assets, your information (including Engagement Data and Aggregated Data) may be transferred as part of that transaction, subject to the commitments in these Terms and our Privacy Policy.
5. Feedback
If you give us suggestions or feedback, you grant us a perpetual, irrevocable, royalty-free license to use it without restriction.
6. Changes
We may update these Terms. For material changes, we will ask you to accept the new version before you continue using the Service. We will not make material changes silently.
